Tell customers how you use their data
In the EU and EEA, when you collect personal data from a customer you must tell them who you are, why you use it and how long you keep it (GDPR, Article 13). The data clause covers those points in plain words.

EU consumer law lists terms that may be unfair, including terms that exclude or limit the business’s liability if a consumer dies or is injured through its act or omission (Directive 93/13/EEC, Annex, point 1(a)). That is why the liability clause says “to the extent the law allows” and keeps those cases out.

Is this rental waiver legally binding?
We can't tell you that, and nobody can without knowing your country and your business. It's a template, not legal advice: have a local lawyer check it and adapt it before you use it.
What should a watersports rental agreement include?
Typically who rents (identity and contact), what (craft and equipment), when (start and return time), where (the allowed area), the renter's declarations (swimming, experience, health), the safety rules (lifejacket), damage, weather and recall, liability, and how you use their personal data. Tick what you need.
Can a waiver exclude all liability?
In the EU, terms that exclude or limit liability for death or personal injury caused by the business may be unfair towards consumers (Directive 93/13/EEC). The template only limits liability to the extent the law allows. Your lawyer can tell you what applies in your country.
Can customers sign it on their phone?
