Rental agreement & waiver template.

Your company, the clauses you need, a form your customers can sign. Then have it checked by a local lawyer.

Template, not legal advice — have it checked by a local lawyer.

Rental, consumer and liability law differ from state to state. This template is a starting point we wrote in plain words; we make no claim that it is valid or enforceable where you operate.

Two state rules worth knowing

Florida lists what goes in the agreement

Florida's livery law says the written rental agreement must include the renter's name, address and date of birth, the number of people aboard, the return time and an emergency contact (Fla. Stat. § 327.54(3)(g)). The template has all of these except the number aboard — add it under “Your own clause”.

Minnesota: name every operator

In Minnesota a motorboat rental business must list on each rental agreement the name and age of every person authorized to operate the motorboat or personal watercraft (Minn. Stat. § 86B.306, subd. 2).

Official texts, checked 2026-10-18. Other states have their own livery rules (Boat rental laws by state) — and that is what the lawyer is for.

Questions

Is this rental waiver legally binding?

We can't tell you that, and nobody can without knowing your state and your business. It's a template, not legal advice: have a lawyer in your state check it and adapt it before you use it.

What should a watersports rental agreement include?

Typically who rents (identity and contact), what (craft and equipment), when (start and return time), where (the allowed area), the renter's declarations (swimming, experience, health), the safety rules (lifejacket), damage, weather and recall, liability, and how you use their personal data. Tick what you need.

Can a waiver exclude all liability?

That is state law, and states differ: some enforce recreational waivers, others limit them or refuse them, especially for negligence. The template only limits liability to the extent the law allows. A lawyer in your state can tell you what applies.

Can customers sign it on their phone?

This template is for paper. A digital rental agreement, signed in the VesselSOS app, is planned for Fleet (SOON).
