England and Wales: local councils can license pleasure boats let for hire, and the people in charge of them, on their own terms and for an annual fee (Public Health Acts Amendment Act 1907, s.94). Where a council uses this power, hiring out an unlicensed boat is an offence. This does not apply on Canal & River Trust waterways. Ask your council whether it licenses hire boats.
Upprunalegt orðalag
“The local authority may grant upon such terms and conditions as they may think fit licences for pleasure boats and pleasure vessels to be let for hire or to be used for carrying passengers for hire … (3) No person shall let for hire any pleasure boat or pleasure vessel not so licensed”
-
Adventure Activities Licensing: a licence from the AALS is needed if you are paid to provide instruction or leadership in watersports to under-18s, i.e. canoes, kayaks or similar paddle craft (and sailing or rafting) on 'specified water'. Bare equipment hire is outside the scheme: the definition excludes instructions given only in connection with supplying equipment.
Upprunalegt orðalag
““facilities for adventure activities” means any facilities which consist of, or include, some element of instruction or leadership given to one or more young persons in connection with their engagement in an adventure activity (other than instructions given solely in connection with the supply of equipment for use in such an activity);”
-
'Specified water' for AALA watersports means tidal waters (e.g. estuaries), inland waters where any part is more than 50 m from the nearest land, or turbulent inland waters (weirs, rapids, fast currents). Providers who serve only people aged 18 or over need no licence.
Upprunalegt orðalag
“tidal waters (eg estuaries), inland waters at a location where any part of those waters is more than 50 metres from the nearest land, excluding any island, or inland waters where the surface of the water is made turbulent because of weirs, rapids, waterfalls or fast-flowing currents.”
-
At sea, the MCA treats a boat used for payment as being in commercial use, not as a 'pleasure vessel', and payment is not the only test. Which small commercial vessel code then applies to hire craft was not confirmed (see gaps).
Upprunalegt orðalag
“When a vessel is not “on a voyage or excursion which is one for which the owner does not receive money for or in connection with operating the vessel or carrying any person, other than as a contribution to the direct expenses of the operation of the vessel incurred during the voyage or excursion”, it is used outside the definition of Pleasure Vessel and is therefore in commercial use.”
-
Inland: if you skipper a boat commercially, for example on guided trips or boat taxis, you need a boatmaster's licence.
Upprunalegt orðalag
“You must apply for a boatmaster’s licence if you want to use your boat commercially.”

Jet skis and other small powered craft are 'watercraft' under the Merchant Shipping (Watercraft) Order 2023. Merchant Shipping Act safe-operation provisions (e.g. dangerous navigation, alcohol) and harbour-authority directions apply to them, and they can be registered on the UK Ship Register as small ships.
Upprunalegt orðalag
““ watercraft ” means any type of craft which— (a) is capable of moving under its own mechanical power, (b) is used, navigated or situated wholly or partly in or on water, and (c) is capable of being used to carry one or more persons.”

At sea the collision regulations (COLREG via SI 1996/75) apply to every vessel, whatever its size.
Upprunalegt orðalag
“any person in charge of any vessel that proceeds to sea, or in waters connected therewith navigable by seagoing vessels, irrespective of size, is required to comply with the Merchant Shipping (Distress Signals & Prevention of Collisions) Regulations 1996”

Inland, you usually need to register or license every boat, including canoes, kayaks and paddleboards, with the navigation authority of the waterway, renewed every year. Without one you can be fined up to £1,000 or have the boat removed.
Upprunalegt orðalag
“You usually need to register or licence your boat if you want to keep or use it on inland waterways, such as rivers and canals. Contact the navigation authority of the waterway you want to use to find out.”
-
On Canal & River Trust waters, unpowered craft (canoes, kayaks, paddleboards, even light inflatables) need a licence, and boats used for business, such as holiday hire boats, need a business licence.
Upprunalegt orðalag
“If you use your boat for any kind of business, such as a floating café or shop, rent it out for people to live on, or use it as a holiday boat, you'll need a business licence .”

Inland, each waterway's navigation authority (Canal & River Trust, the Environment Agency on the Thames and Anglian waterways, Broads Authority, Scottish Canals and others) sets registration and licensing. At sea, the MCA and harbour authorities regulate. The council hire-boat licensing power in s.94 of the 1907 Act does not apply on Canal & River Trust waterways.
