Decide whether you are a sole trader, a partnership or a company, then register with Revenue for the relevant taxes. Companies also register with the Companies Registration Office (CRO).
Upprunalegt orðalag
“When you start a business, you need to know whether you are a sole trader, a partnership or a company . This is necessary to decide what Tax Reference Number you use and what taxes you register for.”

Bareboat hire versus crewed hire: under the Merchant Shipping Act 1992, motorboats hired out without crew still count as 'pleasure craft', so pleasure-craft rules apply. A boat carrying up to 12 passengers for reward, or hired out with a crew provided by the owner, is a 'passenger boat'.
Upprunalegt orðalag
““pleasure craft” means vessels used otherwise than for profit and used wholly or mainly for sport or recreation but includes mechanically propelled vessels that are on hire pursuant to contracts or other arrangements that do not require the owners of the vessels to provide crews or parts of crews for them.”
-
A passenger boat (up to 12 passengers for reward, or hired with crew) may only be used if it holds a passenger boat licence. The Minister (Marine Survey Office) grants it after an inspection carried out no more than 2 months before the application. Skippered trips and guided boat tours therefore need it; bareboat hire does not.
Upprunalegt orðalag
“A vessel shall not be used as a passenger boat unless a licence is in force in relation to it.”
-
Local authorities, harbour authorities and Waterways Ireland can make bye-laws that ban or restrict particular classes of craft (e.g. jet skis) in certain places or times, regulate launching and mooring, set conditions for operators and impose speed limits. Check the bye-laws register of the council or harbour where you operate.
Upprunalegt orðalag
“Bye-laws may be made regulating or controlling the operation of craft or craft of a specified class by— ( a ) a local authority, in waters in its functional area … ( b ) a harbour authority, in or on waters under its control or management, or ( c ) Waterways Ireland, in or on waters under its control or management”

Since 17 July 2023, activities in the maritime area that need a licence, including non-permanent platforms, pontoons or slipways and moorings, require a Maritime Usage Licence from MARA (Maritime Area Regulatory Authority), unless an existing foreshore consent covers them.
Upprunalegt orðalag
“Anyone proposing to undertake any of these activities, from 17 July 2023, must apply to MARA for a licence, unless they have an existing foreshore consent.”
-
Bye-laws can regulate launching, mooring or berthing craft, and the conditions operators must observe in the adjacent area. Beach launching for a rental fleet is therefore controlled locally.
Upprunalegt orðalag
“(ii) matters relating to launching, mooring or berthing craft, (iii) conditions to be observed by operators of craft with regard to the waters or the adjacent area in which craft are used or launched,”

Lifejackets and other equipment rules for pleasure craft and jet skis: see VesselSOS Kit Finder (/kit-finder/), based on S.I. 921/2005 (Mechanically Propelled Pleasure Craft (Safety) Regulations) and the Code of Practice for recreational craft.
Upprunalegt orðalag
“The master or owner of a pleasure craft (other than a personal watercraft) shall take all reasonable steps to ensure that a person who has not attained the age of 16 years wears a suitable personal flotation device”
-
The duties fall on the 'master or owner', and under the Maritime Safety Act 2005 'owner' includes the hirer and operator. A rental business must therefore take all reasonable steps to enforce the age and lifejacket rules for its customers.
Upprunalegt orðalag
““owner” in relation to a vessel, means the person registered under the … as her owner, or, if no person is so registered, the person who owns the vessel, and includes any partowner, charterer, hirer, manager or operator of the vessel;”
-
The official Code of Practice tells users to check with the relevant authority for applicable bye-laws before going on the water. This is a natural part of the pre-rental briefing.
Upprunalegt orðalag
“It is important to check with the relevant authority before going on the water to see if there are any bye-laws that you need to comply with.”

-
Definition: a 'fast power craft' is a motor pleasure craft, other than a jet ski, that can reach 17 knots.
Upprunalegt orðalag
““fast power craft” means a pleasure craft, other than a personal watercraft, the principal means of propulsion of which is derived from a mechanical power source and which attains or can attain a speed through or over water equal to or exceeding 17 knots;”

Large passenger vessels (passenger ships, more than 12 passengers) must have liability insurance in force covering passengers and third parties. If the vessel is on hire, the hirer must be insured. No equivalent statutory rule was found for bareboat hire of small pleasure craft.
Upprunalegt orðalag
“A vessel shall not be used as a passenger ship unless there is in force a policy of insurance under which the owner of the vessel or, if the vessel is on hire, the person to whom it is on hire is insured against any sum which he or his personal representative may become liable to pay”
