Briefing and checklist before each hire

  • Your licence conditions can specify the level of instruction you must give hirers before they go out.

Kayaks, canoes and SUPs

  • For kayaks and waka, licence conditions can require a brightly coloured flag or paddle blades, and hulls in a colour that contrasts with the sea, so your craft are easy to see when underway.

Permits and licences for the business

  • You must get a licence from Nelson City Council before offering rental vessels (or running any other commercial vessel service). The council can waive this at its discretion. The licence is not issued if the Harbourmaster thinks the operation would reduce safety for others or cause congestion or unsafe jostling at embarkation points.

    Show the official wording
“a) No person shall operate a commercial service, whether scheduled, non-scheduled, or offering rental vessels, without first obtaining from Council a licence to do so. Council may, at its discretion, waive this requirement.”
  • Where your vessels or operators need no authorisation under other law, you apply to the council in writing and must show that the vessel is seaworthy, its safety equipment is adequate, the operator is competent and the whole operation is safe. Where another authorisation (such as a Maritime NZ certificate) is required, the council licence is only issued once it is in place.

  • The licence covers only the vessels, operators and operation named in it and can't be transferred. Keep it available for inspection at any time by the Harbourmaster, enforcement officers, Safe Boating Advisors and any prospective client.

Reporting accidents

  • After a collision, sinking, grounding, stranding, a dangerous defect, or damage to a navigation aid or structure, report it to the Harbourmaster as soon as practicable and give full written details within 24 hours. This is in addition to the Maritime Transport Act reporting to Maritime NZ.

Other rules

  • Your licence conditions can say whether a rescue craft must be in attendance while your rental craft are out, and can also set operating areas, daylight or weather limits and safety equipment.

  • Clause numbers for the 'Vessels to be licensed' clause (2.24) are taken from the bylaw's infringement schedule. The text we extracted does not show the clause numbers inline.

  • We have not confirmed the standard licence conditions or level of hirer instruction the Nelson Harbourmaster sets for kayak, SUP or jet ski rental.

  • Nelson City Council and Tasman District Council have separate bylaws. Check which council's waters your hire craft use (Tasman Bay and Abel Tasman are mostly Tasman District).
