“(e) any requirements for rescue craft; (f) any requirements for safety equipment; (g) the level of instruction to be given to persons hiring a vessel; (h) the qualifications required by the person in charge of the vessel.”
Permits and licences for the business
-
If a vessel you hire out is not covered by any Maritime Rule dealing with its operational management, you need a licence from the Harbourmaster before using it for hire or reward. The Harbourmaster issues one only if the operation is safe and the vessel is fit for purpose.
Show the official wording
“1 The owner of a vessel that is not subject to any maritime rule made under the Maritime Transport Act 1994 dealing with the operational management of the vessel must not operate that vessel for hire or reward unless it is licensed by the Harbourmaster.”
-
In the areas listed in Schedule 3 of the bylaws, every vessel used for hire or reward needs a Harbourmaster licence, even if it is also covered by the Maritime Rules.
Show the official wording
“2 The owner of a vessel must not use that vessel for hire or reward in any area specified in Schedule 3 unless it is licensed by the Harbourmaster.”
-
A licence covers only the vessel and operators named in it. Keep it available for inspection at any time by the Harbourmaster, enforcement officers and any prospective client.
Show the official wording
“6 Every licence issued by the Harbourmaster must be available for inspection at any time by the Harbourmaster, or enforcement officers … or any prospective client of the operation.”
Reporting accidents
-
After a collision, sinking, grounding, stranding, a dangerous defect, or damage to a navigation aid or structure, report it to the Harbourmaster as soon as practicable and give full written details within 48 hours. This is in addition to reporting to Maritime NZ.
Show the official wording
“must, as well as complying with any accident reporting requirements of the Maritime Transport Act 1994, as soon as practicable report the occurrence to the Harbourmaster and within 48 hours, provide the Harbourmaster with full written details of the occurrence.”

We have not yet listed which areas are in Schedule 3 (where every hire vessel needs a Harbourmaster licence). Check Schedule 3 of the bylaws or ask the Harbourmaster.
We have not confirmed whether Environment Southland has replaced or is reviewing the 2009 bylaws. Check for a newer version before relying on these clauses.
We have not reviewed the Southland bylaws' lifejacket, PWC and lake-specific rules (for example Fiordland and the Southland lakes) for hire-specific limits.
