New Jersey boat rental laws

6 rules for boat and jet ski rental businesses in New Jersey, from one official source.

Jet ski rental lawNew Jersey's rental rules found here are for jet skis (N.J.A.C. 13:64): renters 16+ with a boat safety course — or, with a State Police permit, a buoyed rental operation area with supervisors, instruction to every renter and a written agreement kept one year.

Livery license or permit for the business

  • With a permit from the Superintendent of State Police, a PWC rental business may rent to persons 16 or older without proof of a boat safety course; permits expire at the end of the calendar year and are applied for with the Marine Services Bureau (business details, hours, fleet size, area coordinates, buoy chart).

Instruction before every rental

  • Permittees instruct every renter before operation: Coast Guard Navigation Rules (meeting, crossing, overtaking, lookout, safe speed), PWC handling, Class A equipment, the rented craft's operation, and alcohol and drugs.

Age limits

  • A PWC rental business may let a renter operate only if the renter is 16 or older with proof of age and of an approved (or substantially similar) boat safety course — unless the business holds a permit for a PWC rental operation area.

Jet ski (PWC) rentals

  • The designated area is at least 100 ft from marked channels and marked by at least four buoys (set each business day, removed before sunset); rented PWCs leave it only to transit, escorted by a supervisor.

  • A reported exemption letting renters 18 or older operate a rented power vessel (not a PWC) without a boat safety certificate after a State-approved pre-rental instruction course (P.L. 2005 c. 292, amended 2011) is not confirmed from the current statute text here.

  • The document is the State Police's published copy of N.J.A.C. 13:64 (Rev. 2020, file dated 2022-01-27); later amendments were not checked.

Federal rules still apply

On top of New Jersey law, the federal rules apply to every boat you rent out:

  • Under federal law a boat leased, rented or chartered to someone else for their pleasure is a “recreational vessel” — so the federal recreational boating rules apply to your rentals.

46 U.S.C. § 2101 — General definitions“"recreational vessel" means a vessel— (A) being manufactured or operated primarily for pleasure; or (B) leased, rented, or chartered to another for the latter's pleasure.”
  • Every recreational vessel needs at least one wearable Coast Guard-approved life jacket on board for each person, used as its approval label says; boats 16 ft or longer also need one throwable device.

  • A child under 13 aboard a recreational vessel under way must wear a Coast Guard-approved life jacket unless below decks or in an enclosed cabin. Where a state has its own child life jacket law, the state age applies on its waters instead.

  • If the state has a statute requiring children of a certain age to wear a life jacket, that state requirement applies on the state's waters instead of the federal under-13 rule.
