Wisconsin boat rental laws

7 rules for boat and jet ski rental businesses in Wisconsin, from 4 official sources.

Rental-specific lawWisconsin has a short motorboat-rental statute (Wis. Stat. § 30.625): first-time-in-the-year renters without a boating safety certificate must get DNR-standard instruction, PWCs may not be rented to anyone under 16 and come with a suitable life jacket, and rented boats must be fully equipped at the time of rental. The DNR also offers a rental-only boating certificate.

Instruction before every rental

  • A business renting motorboats to the public may not rent one to a person operating a motorboat for the first time that calendar year who holds no valid boating safety certificate, unless it first gives that person instruction in the manner set by the DNR.

  • NR 5.16 of the Wisconsin Administrative Code (DNR minimum standards for the rental instruction under § 30.625(1)(a)) was not read.

  • The DNR page refers to a 'licensed watercraft rental agent', but no state licence for rental businesses was found in chapter 30; not listed as a requirement.

  • No state insurance or record-keeping requirement for rental businesses was found.

Federal rules still apply

On top of Wisconsin law, the federal rules apply to every boat you rent out:

  • Under federal law a boat leased, rented or chartered to someone else for their pleasure is a “recreational vessel” — so the federal recreational boating rules apply to your rentals.

  • Every recreational vessel needs at least one wearable Coast Guard-approved life jacket on board for each person, used as its approval label says; boats 16 ft or longer also need one throwable device.

  • A child under 13 aboard a recreational vessel under way must wear a Coast Guard-approved life jacket unless below decks or in an enclosed cabin. Where a state has its own child life jacket law, the state age applies on its waters instead.

  • If the state has a statute requiring children of a certain age to wear a life jacket, that state requirement applies on the state's waters instead of the federal under-13 rule.
