Jet ski rental lawNew York's livery statute (Navigation Law § 73-a) covers jet skis and specialty prop-craft: renters 16 or older, explanation and video or in-water demonstration, a skills demonstration, ID and age check, and records kept one year.
Instruction before every rental
-
Before the rental the livery operator or agent explains and demonstrates — by video or an actual in-water demonstration — how to operate the craft and use its safety equipment.
Show the official wording
N.Y. Navigation Law § 73-a — Personal watercraft and specialty prop-craft“explains and demonstrates to such person by video or actual in water demonstration the operating procedure of such personal watercraft or specialty prop-craft and the use of such vessel's safety equipment;”
-
After the explanation the renter must show the livery operator or agent that they can operate the craft and use the safety equipment.
Show the official wording
N.Y. Navigation Law § 73-a — Personal watercraft and specialty prop-craft“demonstrates to such livery operator or to such designated agent the ability to operate such vessel and use the applicable safety equipment;”
Boater education card for renters
-
Before renting, the renter shows genuine proof of identification and age and — except under the supervised-area rule below — compliance with the boating safety certificate law (Navigation Law § 49).
Show the official wording
N.Y. Navigation Law § 73-a — Personal watercraft and specialty prop-craft“such person has presented genuine proof of identification and age; and except as provided in paragraph (f) of this subdivision, has demonstrated compliance with section forty-nine of this article”
Age limits
-
No livery may lease, hire or rent a personal watercraft or specialty prop-craft to anyone under 16.
Show the official wording

Jet ski (PWC) rentals
-
Until 1 January 2027 (the paragraph is repealed then): a renter over 18 may ride without the certificate if the livery restricts riding to an area no more than 2,500 ft from the livery (or 500 ft from a supervising agent) and the craft or life jacket is clearly marked.
Show the official wording
N.Y. Navigation Law § 73-a — Personal watercraft and specialty prop-craft“a person over eighteen years of age may operate such personal watercraft or specialty prop-craft without the certificate required pursuant to section forty-nine of this article when such operation is restricted by the operator of such livery … no part of which shall be more than twenty-five hundred feet from the livery location”
-
PWC operators must be 14 or older and hold a boating safety certificate or be accompanied aboard by a certificate holder over 18; an owner may not knowingly allow otherwise.

Records to keep
-
At the time of rental the livery records the user's name, address and age and the craft's model, year, manufacturer and registration or documentation number, and keeps the records at least one year.
Show the official wording
N.Y. Navigation Law § 73-a — Personal watercraft and specialty prop-craft“records the name, address and age of the user of the leased, hired or rented vessel, and the model, year, name of manufacturer, and state registration or federal documentation numbers of the leased, hired or rented vessel. Whether a renter over 18 may operate a rented motorboat (not a PWC) from a livery without a boating safety certificate after basic livery instruction — as New York State Parks describes it — is not confirmed from the statute text here.
No New York licence or permit for the rental business itself was found.
What replaces the supervised-area rule of § 73-a(2)(f) after 1 January 2027 was not checked.
Federal rules still apply
On top of New York law, the federal rules apply to every boat you rent out:
-
Under federal law a boat leased, rented or chartered to someone else for their pleasure is a “recreational vessel” — so the federal recreational boating rules apply to your rentals.
Show the official wording
46 U.S.C. § 2101 — General definitions“"recreational vessel" means a vessel— (A) being manufactured or operated primarily for pleasure; or (B) leased, rented, or chartered to another for the latter's pleasure.”
-
Every recreational vessel needs at least one wearable Coast Guard-approved life jacket on board for each person, used as its approval label says; boats 16 ft or longer also need one throwable device.
Show the official wording
33 CFR § 175.15 — Personal flotation devices required“At least one wearable PFD is on board for each person; … No person may use a recreational vessel 16 feet or more in length unless one throwable PFD is onboard”
-
A child under 13 aboard a recreational vessel under way must wear a Coast Guard-approved life jacket unless below decks or in an enclosed cabin. Where a state has its own child life jacket law, the state age applies on its waters instead.
Show the official wording
33 CFR § 175.15(c) and § 175.25“No person may operate a recreational vessel under way with any child under 13 years old aboard unless each such child is either— ( 1 ) Wearing an appropriate PFD approved by the Coast Guard; or ( 2 ) Below decks or in an enclosed cabin.”
-
If the state has a statute requiring children of a certain age to wear a life jacket, that state requirement applies on the state's waters instead of the federal under-13 rule.
Show the official wording
33 CFR § 175.25 — Enforcement of State requirements for children to wear personal flotation devices“If the applicable State statute establishes any requirement for children of a certain age to wear an appropriate PFD approved by the Coast Guard, then that requirement applies on the waters subject to the State's jurisdiction instead of the requirement provided in § 175.15(c) of this part .”
