How to start a SUP, kayak, jet ski or boat rental in Spain

Registering the business

Register with the tax agency's census of businesses (declaración censal de alta, forms 036/037, Agencia Tributaria), and also with Social Security as self-employed (autónomo) or as a company. Companies can be set up online through CIRCE / PAE points.

Permits to rent out watercraft

Jet ski rental by the hour must hold the permits of the competent administrations and file a declaración responsable (sworn statement) with the Capitanía Marítima (harbour master's office) for the place where the base is. It also needs: refuelling only in port or a prepared place; a mooring area or floating platform, since rental jet skis may not be beached or parked on the beach; a briefing area; a rescue boat or jet ski; at least two jet ski instructors (monitores), each supervising at most four jet skis; and a 60 hp maximum for circuit and group-excursion jet skis.

The jet ski decree recognises three rental modes: (a) by the hour, inside a marked circuit; (b) by the hour, as a group excursion led by an instructor, or an individual ride with the instructor driving and the customer as passenger; (c) by the day, from shore-based premises, where the customer navigates like a private user.

A circuit must be marked by at least four buoys, positioned as the Capitanía Marítima decides. Circuits of different rental firms in the same area must be at least one nautical mile apart.

Commercially run beach craft (artefactos flotantes, which include kayaks, SUP-type boards, pedalos and jet skis) need Costas (Servicio Periférico de Costas) authorisation for their launch/landing area within the seasonal-services zones, and then an operating authorisation from the Capitanía Marítima, which checks the buoyage of swimming zones and launch channels.

Using the beach, shore or quay

Beach 'seasonal services' using only removable installations, such as a rental kiosk, are authorised by Costas to the coastal municipality (Ayuntamiento). The municipality may run them itself or tender them to third parties through a public, competitive procedure. In practice, a rental operator wins a municipal beach tender (plan de servicios de temporada).

Seasonal-service authorisations last up to four years, but the installations must be removed at the end of every season. The municipality tells Costas who the third-party operators are before the season starts.

Your duties as an operator

Briefing (jet ski hire): an instructor must give every user, before riding, a theory session on handling and basic navigation rules. It must last long enough for users to take in the essentials.

Customer age and licence rules

Licence-free craft: motorboats up to 5 m with at most 15 hp (no power-reducing device), sailing boats up to 6 m, and beach/floating craft (kayaks, SUP-type boards, pedalos). They must stay within 2 nautical miles of the port, marina or beach of departure, sail by day only, and the user must be 18. Jet skis are excluded. Note: this wording (art. 10 as amended by RD 1188/2025) speaks of 'uso privado' (private use), so check with the Capitanía how it applies to rentals.

Jet skis: the rider must be 18, or 16–17 with signed parental consent carried at all times. No licence is needed for hourly rentals in a circuit or group excursions led by an instructor. Daily rentals need a boating title or a navigation licence (licencia de navegación).

Navigation licence (licencia de navegación): issued after short training by sailing/motorboat federations and nautical schools. It covers jet skis and boats up to 6 m, by day, within 2 nautical miles of a port, marina or shelter. Many rental customers get it on site.

Spanish recreational boats can be rented to anyone holding a valid recreational title or certificate from their country of nationality or residence, if that country is in the EEA or listed in annex IX, within that title's limits.

Jet skis must have compulsory third-party liability insurance (RD 607/1999, which covers recreational and sports boats). Rental jet skis must also carry accident insurance for users.

Jet skis owned by Spanish residents must be registered (matriculadas). Rental jet skis must be registered in the 'lista sexta' (sixth list, commercial use) under the Order of 16 December 1998.
